Disinheritance & Trust
In very few specific cases a child can be excluded from the inheritance.
This is when he/she has committed a very serious act against the parent, such as if he killed him or tried to kill him or if he accused him of a crime knowing that the accusation was false or if he falsified his will or used violence or deceit towards him to force him to make or revoke or change the will.
Simple rudeness towards the parent or the lack of interest in the care of the parent are not reasons to legally exclude a child from the inheritance.
To protect the inheritance you can leave a beneficiary’s inheritance in a discretionary trust fund.
The trust has been widely used in Italy as an alternative to the will, since it allows a planned transfer of the wealth to the next generation, ensuring protection to specific needs.
