Separation will be declared by a family court. If the couple agrees on terms of separation (family house assignment, alimony, child custody, visit and support) the request to the court goes on a faster track. If there is no agreed separation, the court will make a provisional decision and manage the merit trial later.
Whether the terms are agreed or not, both spouses must appear before the judge at the first hearing.
