As many of our clients know, a crucial hearing took place on March 11, 2026, concerning Italian citizenship by descent. At the time of writing on March 12, the Constitutional Court issued a brief indicating that there are no grounds to consider Article 3-bis unconstitutional, nor to refer the case to the European Court. While the final ruling is still forthcoming, it appears likely that the case will be rejected.
However, there is another hearing scheduled for June 9th on the same matter. We are evaluating whether any avenues remain open in relation to this upcoming hearing. At this stage, we do not have the full decision detailing the Court’s reasoning, which will be crucial to assess next steps.
